These Terms of Service ("Terms") cover your use of the FollowOtter website, tools and services (together, the "Service"), operated by FollowOtter ("we", "us", "our"). Using FollowOtter means you accept these Terms. If you do not accept them, do not use the Service.

1. Who can use FollowOtter

You must be 18 or older, or the age of majority where you live. By using the Service you confirm that:

• You can legally enter into a binding contract.
• You will use the Service for lawful, personal, non-commercial purposes.
• You will not use the Service to harass, stalk or violate the privacy of any person.

We may restrict or end access for any user, at our discretion and without notice, if we believe these Terms are being broken.

2. What you agree not to do

• Collect, scrape or analyse data through the Service in a way that breaks Instagram's terms or any third party's terms.
• Point bots, scripts or other automated tools at the Service.
• Work around technical limits or reverse-engineer any part of the Service.
• Use the Service to impersonate, defame or harm any person or organisation.

FollowOtter shows publicly available information as we receive it. We do not guarantee that any of it is complete or accurate. You use it at your own risk.

3. Privacy

We collect a limited amount of data to run the Service, including device and session information. Our Privacy Policy explains what we collect and why. By using FollowOtter you agree to it.

Do not submit personal data about other people unless you have their informed consent or another lawful basis for doing so.

4. Accounts and billing

Some features need a paid subscription. When you subscribe, you authorise FollowOtter to charge your chosen payment method on a recurring basis until you cancel. Sales are final except where these Terms or our Refund Policy say otherwise.

We may change prices, plans or features at any time. If you keep using the Service after a change, you accept it.

5. Disclaimers

• FollowOtter is not affiliated with, endorsed by or sponsored by Instagram, Meta Platforms, Inc. or any other platform.
• The Service is provided "as is" and "as available".
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

6. Limitation of liability

To the fullest extent the law allows, FollowOtter, its affiliates and owners are not liable for indirect, incidental, punitive or consequential damages, including loss of data, access or reputation, arising from your use of the Service.

Our total liability to you will not exceed the amount you paid us in the six months before the claim.

7. Ending access

We may suspend or end your access at any time, for any reason, including a breach of these Terms. You can stop using the Service whenever you like.

8. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the courts located in Wilmington, Delaware.

9. Changes to these Terms

We may update these Terms. When we do, we will post the new version here and change the "Last updated" date above. Continued use after a change means you accept it.

10. Refunds and cancellation

Every new purchase comes with a 7-day guarantee: within seven days of your first payment you can cancel and ask for the original amount back. After seven days the Service has been delivered, so we will cancel the subscription but not refund it.

You can change or cancel your subscription at any time from your account page, or by emailing [email protected]. Cancellation takes effect immediately.
